a. Rental of State Land and Buildings

Q1 How are State-owned land and buildings let out?
A. State-owned properties are let out to the public by way of public tender or direct rental through our agents.


Q2 Can a private individual rent State properties?
A. State properties are available to both private individuals and organisations.


Q3 What are some of the types of properties available for rent/tender and for what uses?
A. Some of the properties available for rent or tender are Black & White bungalows, bungalows, semi-detached houses, terraces, apartments, shops, offices, factories, warehouses, schools, etc. They can be used for residential, commercial, industrial and institutional purposes.

Q4 Can we view State properties listed on SPIO?
A. Yes, you can submit an online request through SPIO to arrange for a site-showround of the desired property(ies).


Q5 May we inspect the property after the closing of the tender?
A. For public tender properties, a site-showround will be conducted for each property. Prospective bidders are strongly encouraged to include their consultants to inspect the property on the appointed day and time of the site-showround as indicated in the Tender Document.


Q6 Is subletting permitted?
A. No, subletting is not allowed without approval from the SLA in writing. Tenants must state the reasons for subletting.


Q7 For property up for tender, can we tender below guide rental?
A. The 'guide rental' in a tender document acts only as an indication of the market rental that the property can fetch under prevailing market conditions. Prospective bidders are advised to bid according to their own assessment of the market rental they are able and willing to pay.


Q8 What are the payments to be made and documents to be furnised for the renewal of a Tenancy Agreement?
A. All rentals or fees must be fully paid prior to renewal of Tenancy Agreement or a Temporary Occupational Licence.

Renewal of Tenancy Agreement:

We require the following to be submitted upon application:
  1. processing fee of ($157.50)
Upon approval, the following documents and fees are required:
  1. security deposit (usually by a Banker's Guarantee)
  2. fire insurance policy (for buildings only)
  3. stamp duty (amount based on rental amount and TA period). Details of computation can be found at the Inland Revenue Authority of Singapore website.
  4. two sets of the TA duly endorsed by the tenant

Q9 If I win a tender, what are the payments to be made and documents to be furnished before signing the tenancy agreement?
A.
  1. Security deposit equivalent to 3 months' rental (excluding GST) in cash, cashier's order, money order, cheque or banker's guarantee (subject to SLA's approval).
  2. Fire insurance policy with the sum insured as stated in the Tender Document for the initial period of the tenancy. The quantum of the coverage is subject to revision at each tenancy renewal, if any.
  3. GST payment of the first month's rent either in cash, cashier's order, money order, cheque or direct banking made in favour of the Commissioner of Lands.
  4. Stamp fee payable for the stamping of the tenancy agreement either in cash, cashier's order, money order or cheque made in favour of the Commissioner of Stamps.
  5. Registration of Companies Certificate as issued by the Accounting and Corporate Regulatory Authority.

Q10 How may we apply for utilities for the property?
A. Upon signing the tenancy agreement with the State, SLA will forward the Tenant a copy of letter notifying the public authorities that the Tenant is a tenant of the State. The Tenant may then proceed to apply for utilities from relevant authorities.


Q11 May we apply for a power load that is higher than the approved maximum load?
A. The tenant may liaise directly with the relevant authorities for a power load that is higher than the prescribed maximum load as advised by SP Power Grid Pte Ltd.


Q12 May we make alterations or renovation to the building?
A. No addition and alteration works should be undertaken without the prior written approval of the SLA and the relevant authorities. In the event that such addition and alteration works have been approved, the Tenant should engage competent professionals to submit plans, drawings and calculations to the relevant authorities for approval before proceeding with any addition and alteration works.


Q13 May we liaise directly with the Urban Redevelopment Authority (URA) and Building and Construction Authority (BCA) on the use and alterations of the property respectively since the approved use is stated in the Tender Document?
A. The tenant is to apply to the SLA for the necessary submissions to be endorsed first before forwarding to the Development Control Division (URA) for formal planning permission as well as to other relevant authorities for approval before commencement of any works. Any unauthorised works or use prior to obtaining permission will be subject to enforcement action.


Q14 Will we be compensated if the site is affected by public redevelopment and as a result the tenancy agreement has to be prematurely discontinued by the SLA?
A. Neither compensation nor costs will be paid to the Tenant if the tenancy is prematurely discontinued. However, reasonable notice will be served on the Tenant concerned on the termination of the tenancy.




b. Temporary Occupation Licence (TOL)

Q15 What is "TOL"?
A. A Temporary Occupation Licence (TOL) is a Licence issued by SLA for the temporary use of State land or for the purpose of the retention of minor encroachment from private properties onto State land.


Q16 What are some examples of uses that require TOL applications?
A. TOLs are issued for the temporary use of State land for the following purposes:
  1. Continued occupation by owners of properties already acquired by and reverted to the Government which are not required for immediate development.
  2. Continued occupation of land (e.g. garden, wall and fence etc) already vested or surrendered to the Government, pending implementation of road or drainage or any other public projects.
  3. Regularisation of minor encroachments on State land.
  4. Temporary use of State land for worksites, site offices, concrete batching plants, storage, outdoor refreshment areas, etc..
  5. Construction of temporary access roads, outlet drains, gas pipes, sewer lines, etc. on State land.
  6. Use of air and subterranean space on State lands for overhead bridges,underpasses, etc..
  7. Construction of temporary structures on State foreshore.
  8. Use of State lands for sand and granite quarrying.
  9. Temporary car parks, open spaces, landscaping etc.
  10. Mini fairs, trade expositions, carnivals, etc. on State land.
  11. Location filming, soil investigations, religious celebrations, wayang stages, dinner sheds, etc. on State land.

Q17 Do I need to apply for permission to construct a temporary access road over State land?
A. Yes. You must apply for a TOL which will be issued on nominal terms. The Licence will only be issued where the proposed road is intended and approved by Land Transport Authority as a public road. - Please click here for a copy of our application form. Please also note that should your application be approved, you may be required to pay for the TOL fee through Interbank Giro.


Q18 What fees do I have to pay?
A. Purchase of the Cadastral Plan (Maps)
  • $15.05 inclusive of GST if purchased from our customer service counter at 26th storey
  • $11.55 inclusive of GST (excluding an optional postage fee of $3.50) if purchased through INLIS (Integrated Land Information Services)

Non-Refundable Processing Fee
$157.50 for category A uses and $43.80 for category B uses, inclusive of GST.
  • Examples of uses under Category A are advertisement signages, worksites, storage and sales events.
  • Examples of uses under Category B are funeral wakes, location filming, religious events and weddings.
  • (For a more detailed list of the uses under each category, please refer to section C of the application form.)

TOL Fee
The amount of TOL fee payable will depend on factors such as usage, location, size of the TOL area, site condition and tenure.

Refundable Security Deposit
Ranges from $150 for a 3-month TOL fee depending on the usage, size of the TOL area and other relevant factors on a case by case basis. However, the security deposit shall be forfeited if the licensee fails to comply with any of the TOL conditions.


Q19 How do I get my security deposit back?
A. The security deposit lodged under the TOL will be refunded to your bank account or the cheque returned once the site has been reinstated to original condition to SLA's satisfaction.


Q20 I understand that there are standard rates for some of the TOLs. Where can I obtain a copy of the TOL rates?
A. The standard rates can be found here.


Q21 Where can I obtain a copy of the TOL application form?
A. TOL application form can be obtained from SLA's reception counter at the 26th Storey of 8 Shenton Way or you can click here for a copy of our application form. Please also note that should your application be approved, you may be required to pay for the TOL fee through Interbank Giro.


Q22 How do I fill in the application form?
A. Section A -
Fill in the name/company of the proposed licensee. For a company/society/business, please fill in the Accounting and Corporate Regulatory Authority (ACRA) number. Please note that TOL will be issued to a single party only. We do not accept joint applicants.

Section B -
The Cadastral plan (site plan) can be purchased at our customer reception counter at 26th Storey, 8 Shenton Way, (at $15.05) or thru INLIS (at $11.55). (Please select 'Self Service Map Production System' from the 'Please click here to select service' pull-down menu.) Indicate clearly on the cadastral plan the location and the dimension of the proposed site. The plan submitted shall be up to A3 size.

If you are unable to provide the area required, you can leave the entry(ies) blank. Our officer(s) will contact you to confirm the area, upon the receipt of the application form and the necessary documents.

Section C -
Tick the proposed usage. However, if the proposed usage is not listed, please tick under 'others' and describe.


Q23 What must I submit when applying for a TOL?
A.
  1. Completed application form
  2. Cadastral plans for all uses
    The Cadastral plan (site plan) can be purchased at our customer reception counter at 26th Storey, 8 Shenton Way, (for $15.05) or thru INLIS (for $11.55). (Please select 'Self Service Map Production System' from the 'Please click here to select service' pull-down menu.) The location and the dimension of the proposed site must be clearly indicated on the Cadastral plan. The plan submitted shall be up to A3 size.
  3. For company/society/business, please submit a copy of the ACRA certificate.
  4. Other Supporting documents for uses stated below:
    1. Advertisement Signages and Project Signboards
      Detailed drawings and information of size of signages
      Please note that to put up project signboards and/or signages, you may require an advertisement licence by Building and Construction Authority (BCA). As such, SLA will assist to forward the same application and all attached documents to BCA for their evaluation. BCA may liaise with you directly thereafter if required.     2. Worksites/showflats, storage & temporary accesses
      A copy of the letter of contract/award. (Only the main contractor is eligible to apply for the TOL)
    3. Sales events/entertainment events & sports & recreational uses
      Drawings to indicate the number and sizes of the booths, layout plan, rentals and usage of the booths.
    4. Religious functions/wayang and dinners
      Supporting letter from the Adviser to grassroots organisation of the constituency.
  5. Payment for the non-refundable processing fee

Q24 When am I required to produce my TOL?
A. The TOL and the attached conditions are important documents. They help to establish that you are a legitimate user of the property. They should be produced on demand to any Collector of Land Revenue, the police or public officers discharging their duties.
